The client was a very pleasant wife and new mother who saw advertisements for many eyelash serums promising to improve the growth and darkness of eyelashes. She had heard that some products contained harsh ingredients that caused various side effects. Then she found this particular lash serum that did seem to contain anything dangerous. She read the Frequently Asked Questions section of the product’s labeling, which promised no adverse effects. She even asked a product representative if she should be concerned about the lash growth serum causing her any issue, which the rep denied.
After just weeks of using the lash growth serum, our client noticed two styes on her eyes. After they healed, more developed. This continued repetitively until she was officially diagnosed with Meibomian Gland Dysfunction (MGD). Her eye doctor explained to her that an ingredient contained in the serum caused the majority (!) of her meibomian glands to get permanently blocked. The condition caused by the product caused her to suffer chronic dry eye, styes, and inflammation.
Our attorney investigated the product and the problem ingredient. She consulted with experts in the field and collected records and documentation from the client. Our firm got in contact with the manufacturer and began discussing the claim with the manufacturer’s attorneys. LOU LAW’s attorney advocated for the client in pre-suit negotiations which led to mediation.
As with all serious injury cases, a lot is at stake during the negotiation period. Although it is in the client’s best interest to settle the case as early as possible, it is vitally as important to stand your ground and fight for a fair recovery. In this particular case, the negotiations were very challenging. Many interested parties were involved behind the scenes and the defendant seem indecisive at times. The challenge, in this case, was to stay patient and keep our eyes on the end result.
We were able to successfully settle the case in presuit, after very long and arduous negotiations. Our client was able to move forward with her life and use the recovery funds to seek treatment for her condition. LOU LAW’s attorney was pleased with the outcome because our client was spared a long litigation process and walked away with a fair settlement without much risk to her.
From the day that the client retained LOU LAW with her cosmetic product liability case to the day she received the funds, the firm’s efforts took approximately 14 months.
Even when a cosmetic product is advertised as “safe” and “without side effects” it may not be true. Know the ingredients that are in your cosmetic products and understand what makes those products effective. You should consult with a doctor before using products that sound too good to be true.
